Important Precautions During the U.S. Import Customs Clearance Process

1. Pre-Shipment Preparation

  • Importer Identification Number (EIN/IRS) is required for all formal entries. Without a valid tax ID, customs clearance will be rejected.
  • Customs Bond is mandatory for all commercial shipments entering the U.S. No Bond = No clearance.
  • ISF 10+2 must be filed at least 24 hours before loading. Late filing will lead to heavy fines, cargo hold, or even port rejection.
  • Accurate HTS classification is critical. Wrong classification may cause higher tariffs, customs inspection, or seizure.

2. Documentation Requirements

  • All documents (invoice, packing list, bill of lading, origin certificate) must be true, consistent, and complete.
  • Inconsistent information between documents is the top reason for customs delay and inspection.
  • Products regulated by FDA, FCC, CPSC, USDA, etc., require additional certificates or prior approval. Missing documents will result in automatic detention.

3. Customs Declaration & Compliance

  • Declared value must be truthful. Under-valuing goods is considered fraud and will lead to penalties, fines, and legal risks.
  • Only licensed U.S. customs brokers can legally submit entries through the ACE system.
  • Be aware of additional fees: tariff, MPF (Merchandise Processing Fee), harbor maintenance fee, and possible anti-dumping duties.

4. Customs Inspection & Risk Control

  • Customs may select shipments randomly or based on risk for document review, X-ray, or physical inspection.
  • Preparation of complete and compliant documentation is the best way to reduce inspection probability.
  • Do not attempt to avoid inspection by misrepresentation. It will severely damage the importer’s credibility.

5. Timing, Logistics & Cost Control

  • Pre-clearance before arrival can greatly speed up release upon cargo arrival.
  • Avoid delays to reduce expensive port storage and demurrage charges.
  • Cooperate with your broker promptly to provide supplementary documents when requested.

6. Post-Clearance Management

  • All customs entry documents must be kept for at least 5 years for potential customs audits.
  • Maintain good import compliance history to enjoy faster clearance and lower risks in future shipments.
